Driver Agreement

This Driver Agreement ("Agreement") is entered into between you ("Driver") and Yaadtrip Tours ("the Company," "we," or "us"). By completing and submitting a driver application, or by continuing to use the Yaadtrip driver platform, you acknowledge that you have read, understood, and agree to be bound by all terms in this Agreement.
1. Independent Contractor Relationship
Drivers operate as independent service providers, not employees, agents, or partners of Yaadtrip Tours. You are responsible for all taxes, insurance contributions, and legal obligations arising from your own business activity. Nothing in this Agreement creates any employment, agency, franchise, joint venture, or partnership relationship. You retain full discretion over when and how you provide transportation services, subject to compliance with this Agreement and applicable law.
2. Eligibility and Legal Requirements
To be eligible and to remain active on the Yaadtrip platform, you must at all times:
- Be at least 21 years of age
- Hold a valid Jamaican driver's license of the appropriate class for the vehicle operated
- Possess and maintain a valid Public Passenger Vehicle (PPV) badge issued by the Jamaica Transport Authority (JTA), or any other license required to operate for hire under Jamaican law
- Hold valid and adequate motor vehicle insurance covering public passenger use
- Maintain a current vehicle registration and roadworthiness certificate
- Provide a valid Police Record / Certificate of Character issued within the last six (6) months by the Jamaica Constabulary Force (JCF) at application, and again upon request by Yaadtrip Tours
- Not be subject to any court order, probation, or legal restriction that prohibits driving or transporting passengers for hire
3. Document Accuracy and Ongoing Obligations
You must submit truthful, complete, and accurate information and documentation when applying and at all times thereafter. You are required to:
- Notify Yaadtrip Tours immediately if any submitted document expires, is suspended, revoked, or otherwise becomes invalid
- Re-submit renewed documents before their expiry date
- Inform us of any criminal charge, conviction, or licensing violation that occurs while you are active on the platform
Providing false or misleading information is grounds for immediate permanent removal and may be reported to relevant authorities.
4. Vehicle Standards
Your vehicle must remain safe, clean, roadworthy, and appropriate for the service type and passenger count at all times. Specific requirements include:
- Interior and exterior must be clean and free of damage that would reasonably concern passengers
- Air conditioning must be functional for all passenger trips
- Seatbelts must be available and working for every passenger seat in use
- The vehicle must not carry more passengers than its licensed and registered seating capacity
- Yaadtrip Tours may request photos, spot inspections, or maintenance records at any time and may suspend access pending a satisfactory review
5. Professional Conduct and Passenger Safety
You are expected to maintain the highest standards of professionalism and safety at all times while on a trip. This includes:
- Arriving at the pickup location on time and in appropriate attire
- Greeting customers professionally and assisting with luggage where needed
- Driving safely, obeying all traffic laws, and observing speed limits
- Not using a mobile phone without a hands-free device while driving
- Never driving under the influence of alcohol, cannabis, prescription medications that impair ability, or any other controlled substance
- Not playing loud, offensive, or explicit music unless requested by the customer
- Respecting customer privacy — do not record customers without consent, share personal information, or solicit private business outside the platform
- Not carrying unauthorised passengers or cargo alongside a booked customer
- Not smoking or using vaping products in the vehicle at any time
Zero tolerance applies to harassment, discriminatory language, threats, violence, theft, sexual misconduct, or any form of criminal conduct toward customers, other drivers, or staff.
6. Booking Acceptance and Trip Operations
When you accept a trip on the Yaadtrip platform, you are committing to provide the service as described. You must:
- Accept only trips you are able and prepared to complete
- Mark the trip as started using the platform when you begin the journey
- Mark the trip as completed once the customer has been safely delivered to their destination
- Contact the customer and support if unforeseen delays or incidents arise
- Not deviate from the agreed route without customer consent except for genuine safety, legal, or emergency reasons
7. Cancellation Policy for Drivers
Drivers may cancel an assigned or confirmed booking only if at least 48 hours remain before the scheduled pickup time. Cancellations made inside 48 hours are considered a breach of service commitment and may result in:
- A formal warning recorded on your driver profile
- Temporary suspension from the platform
- Permanent deactivation after repeated violations
Emergency exceptions may be considered on a case-by-case basis at Yaadtrip's sole discretion. If you must cancel, do so immediately and contact support. You may not accept a new booking for the same time slot after cancelling.
8. No-Show Policy
If a customer is a no-show, you must remain at the pickup location for at least 60 minutes past the scheduled time and make reasonable attempts to contact the customer before marking a no-show. Falsely marking a customer as a no-show is considered fraud and will result in immediate deactivation.
9. Late Start Policy
Trips must be started within the designated window. If you are late, you must request a late start approval through the platform. Starting a trip without proper approval is a policy violation. Repeated late starts may affect your platform standing and ability to accept bookings.
10. Earnings and Payouts
Driver earnings are calculated based on completed eligible trips at the rates shown in the platform at the time of each booking. Yaadtrip Tours may:
- Withhold or adjust payment for disputed, fraudulent, or incomplete trips
- Adjust rates for product promotions, service changes, or market conditions with reasonable advance notice
- Deduct amounts for confirmed chargebacks, policy violation penalties, or amounts owed under this Agreement
You are responsible for declaring and remitting all applicable taxes and statutory contributions relating to your income. Yaadtrip Tours does not withhold income tax on your behalf.
11. Ratings, Performance, and Quality Reviews
Customer ratings, trip completion rates, cancellation rates, no-show rates, and complaint histories are monitored to maintain service quality. Drivers are expected to maintain:
- A minimum average customer rating of 4.0 out of 5
- A trip completion rate of at least 90%
- No more than 2 driver-initiated cancellations within any 30-day period
Falling below these thresholds may result in a performance review, account restrictions, or deactivation. You will ordinarily be given notice and an opportunity to improve before deactivation except in cases involving safety, fraud, or criminal conduct.
12. Background Checks and Ongoing Verification
By submitting an application, you expressly consent to Yaadtrip Tours conducting background checks, including criminal record verification through the Jamaica Constabulary Force, and verifying all submitted documents. You also consent to periodic re-verification during your time on the platform, including requests for updated Police Records.
13. Data and Privacy
By using the platform, you consent to Yaadtrip Tours collecting, storing, and processing operational data needed to provide and improve services. This includes driver profile information, booking history, trip timestamps, location events where applicable, document records, and communications. Data is handled in accordance with our Privacy Policy.
14. Suspension and Deactivation
Yaadtrip Tours may suspend or permanently deactivate a driver's platform access at any time, with or without prior notice, for reasons including but not limited to:
- Safety risks to customers or the public
- Criminal charges or convictions
- Document fraud, misrepresentation, or expired required documents
- Repeated service failures or poor ratings
- Conduct that damages the reputation of Yaadtrip Tours
- Violation of any term of this Agreement
15. Limitation of Liability
To the fullest extent permitted by the laws of Jamaica, Yaadtrip Tours is not liable for indirect, incidental, special, or consequential losses arising from your participation on the platform, fluctuations in booking demand, system downtime, third-party actions, or events outside our reasonable control. Our total liability to you for any claim shall not exceed the amounts paid to you in the 30 days preceding the event giving rise to the claim.
16. Indemnification
You agree to indemnify, defend, and hold harmless Yaadtrip Tours, its directors, staff, and agents from any claims, losses, damages, fines, or legal costs arising from your negligence, misconduct, breach of this Agreement, breach of applicable law, or any incident involving your vehicle while operating on the platform.
17. Governing Law and Disputes
This Agreement is governed by the laws of Jamaica. In the event of a dispute, the parties shall first attempt resolution through good-faith discussion with Yaadtrip Tours support. If unresolved, disputes shall be submitted to the competent courts of Jamaica. Nothing in this clause limits Yaadtrip Tours' right to seek urgent injunctive or other equitable relief in any jurisdiction.
18. Policy Updates
Yaadtrip Tours may update this Agreement at any time. The revised version will be published on this website with an updated date. Continued use of the platform after the updated date constitutes your acceptance of the revised Agreement. If you do not agree, you must stop using the platform and notify support.
